What is A Postnuptial Agreement?
A Postnuptial Agreement (a “postnup”) is a contract made by two individuals who are married. The purpose of a Postnuptial Agreement is to outline how assets are to be owned during the marriage (for example, as separate or community property), and how they will be divided in the event of divorce or the death of a spouse.
What is Required for a Postnuptial Agreement to be valid?
Under Washington law, a postnup needs to be procedurally and substantively fair to both parties to be enforceable. One element of procedural fairness is independent attorney representation for each spouse. Other formal requirements include the need for the agreement to be in writing, executed in support of marriage, and signed by both parties in the presence of a notary.
